PAIA Manual

Manual in terms of Section 51 of the Promotion of Access to Information Act, 2 of 2000 (PAIA), as amended by the Protection of Personal Information Act, 4 of 2013 (POPIA)

1. Introduction

This manual is published in terms of Section 51 of the Promotion of Access to Information Act, 2000 (PAIA), which gives effect to the constitutional right of access to information held by any person or body, where that information is required for the exercise or protection of a right. It also incorporates information required under the Protection of Personal Information Act, 2013 (POPIA), which governs how personal information is processed.

This manual explains what records Localquisition holds, how to request access to them, and how Localquisition processes personal information.

A general guide on how to use PAIA and POPIA to exercise your rights is available from the Information Regulator (contact details in Section 9).

2. About Localquisition

Localquisition is a trading name of Bosman Digital, a sole proprietorship based in Pretoria, Gauteng, South Africa, providing local digital marketing and business growth services to trade and home-service businesses.

All requests for access to records under PAIA should be directed to the Information Officer using the above contact details.

4. How to request access to a record

A person wishing to request access to a record held by Localquisition must complete the prescribed PAIA Request for Access to Record Form (Form 2), available from the Information Regulator's website (inforegulator.org.za), and submit it to the Information Officer using the contact details in Section 3.

The request must provide sufficient detail to enable the record to be located, and must indicate the form of access required and how the request may be delivered to the requester.

Response timeframe: Localquisition will respond within 30 (thirty) calendar days of receiving a valid request, as required by PAIA. This period may be extended once, by up to 30 further days, in circumstances permitted by PAIA (for example, where the request is for a large volume of records or requires consultation with a third party).

Fees: A request for access to a requester's own personal information is not subject to a request fee. For requests relating to other records, the prescribed fees set out in the PAIA Regulations may apply, and Localquisition will notify the requester of any applicable fee before processing the request.

Grounds for refusal: Access to a record may be refused only on the grounds permitted under PAIA (for example, protection of a third party's personal information, commercially sensitive information, or legally privileged material). Where access is refused, in whole or in part, Localquisition will provide written reasons for the refusal and inform the requester of their right to lodge an internal appeal or approach the Information Regulator or a court.

6. Categories of records held by Localquisition

Localquisition holds records falling broadly into the following categories:

7. Localquisition's role as Operator

Where Localquisition manages marketing campaigns on behalf of a client, it may process personal information belonging to that client's own customers or leads (for example, an enquiry generated through a client's website booking or contact form). In this capacity, Localquisition acts as an Operator under POPIA, processing such information only on the client's documented instructions, and only for the purpose of delivering the agreed services to that client. Requests for access to this category of information should, where possible, be directed to the relevant client directly, as they remain the responsible party for that information.

8. Purpose of processing and planned cross-border flows

Personal information described in Section 6 is processed for the purposes described in Localquisition's Privacy Policy, available at localquisition.com, including responding to enquiries, delivering services, billing, and business development.

Some personal information may be processed by third-party service providers whose servers are located outside South Africa (including Google and WhatsApp/Meta). Details of these third parties and the safeguards applied are set out in Localquisition's Privacy Policy.

9. Information Regulator contact details

Should a requester wish to lodge a complaint regarding a PAIA request that has been refused or not responded to, or a complaint regarding the handling of personal information under POPIA, the Information Regulator may be contacted as follows:

10. Security measures

Localquisition applies reasonable technical and organisational measures to protect the records and personal information it holds, including password-protected systems and password management tools, two-factor authentication, and restricted access on a need-to-know basis. Further detail is available in Localquisition's Privacy Policy.
